6. User Submissions & Generated Content

6.1 Submission Rights & Responsibility

Users may provide materials such as article briefs, URLs, or other inputs to generate content through Blogbuster. By submitting such materials, users confirm that they have the necessary rights to share and authorize Blogbuster to access and use this data.

6.2 User Ownership

You retain ownership of, and are solely responsible for, your User Contributions.

6.3 License to Blogbuster

By submitting any User Contribution, you grant us a worldwide, royalty‑free, perpetual, irrevocable, sublicensable, transferable license to use, host, store, reproduce, modify, create derivative works from, publish, display, and distribute that User Contribution in connection with operating and improving the Service.

Additionally, by using the Service, you authorize Blogbuster to display your company logo as a customer reference on our marketing website or landing pages, unless you explicitly opt out by contacting us.

6.4 Acceptable Submission Policy

Users must not submit content that violates applicable laws, infringes on third-party rights, or promotes harmful, defamatory, or inappropriate material. Blogbuster disclaims liability for improper use of third-party data provided by users.

7. Acceptable Use & Prohibited Conduct

8. Backlink Exchange Terms

8.1 Third‑Party Sites

Listings may reference websites operated by third parties. We do not control or endorse, and are not responsible for, any third‑party sites or their content.

8.2 Automated Placement & Your Responsibility

When you activate or purchase any backlink package, our system automatically creates and publishes the agreed‑upon links—no manual preview or approval step is provided. Before enabling a package, make sure those links align with your own policies, brand, and risk tolerance. Because every website, search engine, and campaign is different, we cannot guarantee (a) the safety, reputation, or compliance of any third‑party site; (b) that a backlink will improve your rankings or traffic; or (c) that search‑engine algorithms or policies will remain unchanged.

8.3 Search‑Engine Guidelines

Search engines set and update their own rules. They may reduce visibility or penalize sites they believe use links in ways that violate those rules. By choosing to use the Backlink Exchange you accept that risk and agree to indemnify and hold us harmless from any related penalties, losses, or liabilities.

8.4 Commitment to Best Practices

We actively monitor search‑industry trends and guidelines, and we routinely refine our automated placement systems, link sources, and quality‑control checks to align with widely accepted best practices. While these efforts are intended to reduce the likelihood of negative outcomes, no solution can eliminate all risk. Accordingly, the disclaimers and limitations of liability in Sections 11 and 12 continue to apply.

9. Fees, Payment & Refunds

9.1 Fees

Prices for subscriptions or marketplace transactions are as listed on the Service and are subject to change at any time before purchase.

9.2 Payment Processor

Payments are processed by third‑party payment providers. We are not responsible for their acts or omissions.

9.3 Refund Policy

First‑time subscribers may request a full refund within seven (7) calendar days of the initial subscription payment by contacting us. Refunds are limited to one per customer and will be issued to the original payment method. After the 7‑day period, all sales are final and non‑refundable.

10. Modifications, Suspension & Termination

We may modify, suspend, or terminate the Service—or your access to it—at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your license to use the Service will automatically terminate, but Sections 5, 6, 8, 11–17 will survive.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Blogbuster disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non‑infringement, and results. Without limiting the foregoing, we make no warranty that:

  • The Service will be uninterrupted, timely, secure, or error‑free;
  • Any Content (including User Contributions or backlinks) is accurate, reliable, or compliant with search‑engine guidelines;
  • The Service will improve search rankings, domain authority, traffic, or revenue; or
  • Search‑engine algorithms or policies will remain unchanged.

12. Limitation of Liability

To the maximum extent permitted by law, in no event will Blogbuster, its affiliates, licensors, or service providers be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any lost profits, lost revenue, lost data, business interruption, or cost of substitute services, arising out of or in connection with the Service or these Terms—even if advised of the possibility of such damages. Our total cumulative liability for any claims relating to the Service will not exceed the amount you paid us, if any, for the Service in the twelve (12) months before the event giving rise to liability.

13. Indemnification

You will defend, indemnify, and hold harmless Blogbuster and its officers, directors, employees, agents, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service; (b) your User Contributions; (c) your violation of these Terms or any laws; or (d) your interactions with third‑party websites or services (including backlink transactions).

14. Governing Law & Venue

These Terms and any dispute arising from or related to them will be governed by and construed in accordance with the laws applicable in our principal place of business, without regard to its conflict‑of‑law principles. The courts located in that jurisdiction will have exclusive jurisdiction over all disputes not subject to arbitration.

15. Dispute Resolution & Arbitration

15.1 Informal Negotiations

Before commencing formal proceedings, you agree to first contact us and attempt to resolve the dispute informally for at least thirty (30) days.

15.2 Binding Arbitration

If we cannot resolve the dispute informally, any controversy or claim arising out of or relating to the Service or these Terms shall be settled by binding arbitration administered by a recognized arbitration provider, under its rules then in effect. The arbitration will be conducted in English by a single arbitrator.

15.3 Class‑Action Waiver

You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or class member in any purported class or representative proceeding.

16. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term.

17. Entire Agreement

These Terms constitute the entire agreement between you and Blogbuster regarding the Service and supersede all prior or contemporaneous understandings. The headings are for convenience only and have no legal effect.

By using Blogbuster, you confirm that you have read, understood, and agree to these Terms and Conditions.
